1. Introduction
LEGACY by Gabriel ("LEGACY", "Platform", "we", "us", or "our") is an educational website/platform operated by Gabriel Oluwademilade Adeniji (the "Developer") and his Team. The Platform provides academic resources, CBT preparation tools, e-learning materials, core library e-books, science simulation kits, news/community forums, student support services, and related content for students, aspirants, and alumni of FUTA and other institutions. By accessing or using the Platform or its Services, you ("User", "you", or "your") agree to these Terms, our Privacy Policy, and any referenced guidelines. If you do not agree, cease use immediately.
These Terms form a legal agreement governed by Nigerian law (including NDPA 2023, Cybercrimes Act 2015, Copyright Act LFN 2004, FCCPA 2018, Child Rights Act 2003, Contracts Law) and international standards (GDPR principles, Berne Convention, TRIPS, UNCRC). The Platform is for educational purposes only; no professional advice or academic guarantees are provided.
2. Definitions
- User: Anyone using the Platform.
- Account: Registered profile for premium features.
- Content: All materials (text, images, videos, e-books, questions, code, forums).
- Recharge System: Voucher-based payment system for plans.
- Referral System: Code-sharing reward program.
- Developer: Gabriel Oluwademilade Adeniji.
- Third-Party Services: Integrated external services or tools.
3. Acceptance & Eligibility
By using the Platform, you confirm you have read, understood, and accepted these Terms. Users under 18 require parental consent per Child Rights Act 2003 and UNCRC. The Platform is available to persons ≥ 13 years old (with consent if < 18) and legally able to contract. Continued use after updates implies acceptance; disagreeing users must cease use.
4. User Accounts
Registration: Provide accurate info and keep it updated.
Security: Safeguard credentials; enable 2FA if available; report breaches immediately. We are not liable for losses from unauthorized access.
Ownership: Accounts are personal and non-transferable; sharing may lead to suspension.
Termination: You may delete your account by contacting support; data may be retained up to 7 years. We may suspend or terminate for violations, non-payment, inactivity (≥ 6 months), or legal requirements, with notice when possible.
5. Services & Features
Platform features include CBT tools, e-learning, e-books, labs, news/forums, support, referral system. Basic features are free; premium plans are paid and non-overlapping. Referral rewards are based on verified activities; abuse may lead to revocation. Services may change or be discontinued without liability; no guaranteed uptime.
6. Payments & Financial Terms
All fees in NGN, exclude VAT unless stated; payments are final except as required by law. Payments via manual transfer; send proof to support for verification (1–24 hrs). Users bear bank fees. Disputes must be raised within 7 days. Referral rewards are non-monetary.
7. User Conduct
Permitted use is educational only. Prohibited: illegal activities, copyright infringement, harassment, spam, bots/scrapers, referral abuse, impersonation. We reserve the right to moderate content and suspend violators. We cooperate with legal authorities under Nigerian Evidence Act 2011.
8. Privacy & Data Protection
We comply with NDPA 2023, GDPR principles, and related laws. We collect personal data (email, UID, timestamps, referrals) and anonymized analytics. Data is used to provide Services and improvements; not sold. Shared only with contracted providers or as required by law. Security measures include HTTPS and access controls; breaches reported within 72 hrs. Users may request access, correction, or deletion via support.
9. Disclaimers & Liability
Platform is provided “as is” without warranties. We are not liable for indirect or consequential damages. Liability is capped at amounts paid in the past 12 months (max ₦50,000). No liability for force majeure events (e.g., internet outages, strikes, pandemics).
10. Indemnification
You agree to indemnify and hold harmless the Developer and affiliates from any claims or damages arising from your use of the Platform or violation of these Terms.
11. Governing Law & Dispute Resolution
These Terms are governed by Nigerian law. Disputes are resolved by negotiation, then mediation (FCCPC or Lagos Multi-Door Courthouse), then arbitration under Arbitration and Mediation Act 2023 in Akure or litigation in Ondo State courts. No class actions.
12. Miscellaneous
If any provision is invalid, the remainder stays in effect. We may assign these Terms without notice. These Terms constitute the entire agreement. Notices to you via email or Platform are valid under Evidence Act 2011.
